Assignment Description: The European Bank for Reconstruction and Development (the "EBRD" or the "Bank") intends to engage a consultant (the "Consultant") in order to provide practical assistance to the Moldova?s National Regulatory Agency For Electronic Communications and Information Technology (ANRCETI) to implement the new Electronic Communications Law (2007), which moves the country?s communications policy and regulatory framework towards harmonization with that of European Union ("EU").
The main objectives of the Consultant?s assignment would be to provide full and substantive practical support to ANRCETI in the following areas:
- training of ANRCETI staff and communications sector stakeholders;
- enhancement of institutional and decision-making capacity;
- drafting and implementation of secondary legislation and supporting frameworks;
- legislative review;
- elaboration and implementation of a market definition and assessment mechanism;
- elaboration and implementation of revised licensing/authorisations framework;
- assistance and support with operational casework;
- assistance and support with regulatory accounting;
- elaboration and implementation of a price cap and rebalancing framework;
- assistance and support with respect to development of a Reference Interconnect Offer;
- elaboration and implementation of a local loop unbundling framework;
- assistance and support with cost of capital calculation;
- assistance with definition of universal service obligation;
- elaboration and implementation of a number portability framework;
- assistance and support with the enchancement of the internal management of ANRCETI.
Assignment Duration: It is anticipated that the assignment will begin around March/April 2009 and last for up to 24 months. The contract may be extended subject to the needs of the assignment, satisfactory performance of the Consultant and availability of funding.
Maximum Budget Available for the Assignment: EUR 875,000.00; exclusive of VAT.
The consultant must determine whether any VAT would be chargeable on the services and the basis for that determination, without taking into consideration the Bank's special status as an IFI and state this to the Bank in their financial proposal. To the extent that a consultant incurs input VAT on goods and services purhcased in connection with the provision of services (eg VAT on airline ticket) which is not otherwise recoverable by the consultant from the local tax authority, the gross cost to the consultant of such expenses shall be treated as a reimbursable expense.
Funding Source: It is anticipated that the contract will be financed jointly from the EBRD early Transition Country and Shareholder Special Funds.
Eligibility Restrictions: There are no eligibility restrictions based on nationality.
Consultant Profile: Corporate Services are required. The Consultant should be a firm or a consortium of firms and should be able to demonstrate:
- Comprehensive detailed knowledge of and practical experience of working with the EU Communications Regulatory Framework;
- Awareness of the Moldovan local legal, economic and institutional environment and working methods;
- Prior relevant practical experience implementing similar projects in the countries of the Commonwealth of Independent States or Eastern/Southeastern Europe.
The Consultant?s team will be expected to include Romanian and Russian language capacity.
The Consultant will be required to commit to spending at least 50% of time during the assignment to on-the-ground presence in Moldova.
Specifically, the EBRD seeks an experienced multi-disciplinary team comprising senior regulatory, economic, legal and technical experts with preferably the following qualifications and experience:
- senior team leader/project director with at least 15 years relevant practical experience;
- senior lawyer(s), with at least 12 years relevant practical experience, with extensive proven legal drafting skills;
- senior adviser(s) in the field of licensing/authorisations, with at least 12 years relevant practical experience;
- senior adviser(s) in the field of access/interconnection, with at least 12 years relevant practical experience;
- senior adviser(s) in the field of tariffing/costing and regulatory accountinf, with at least 12 years relevant practical experience;
- senior advisor(s) in the field of number portability, with at least 12 years relevant practical experience;
- senior advisor(s) in the field of universal service, with at least 12 years relevant practical experience;
- senior training professional, to oversee training and knowledge transfer components, with at least 12 years relevant practical experience;
- local adviser(s) with at least 7 years relevant practical experience.

In order to determine the qualifications and competence of consulting firms seeking to be shortlisted, the information submitted should include the following:
- company profile, organisation and staffing;
- details of experience or similar assignments undertaken in the previous five years, including their locations;
- CVs of staff who could be available to work on the assignment.
The above information should not exceed 20 pages excluding CVs.
